How to Find out if Your Phone is being Tapped?

In an age where cell phone tap is common place, you need to check for phone taps for suspicious activities. Telephone tapping is also known as wire tapping in the United States.
The telephone which is being monitored was being connected to some kind of monitoring device by intercepting the wires thus drawing or tapping a small quantity of electrical signals. This was a means of covertly monitoring the conversations by third parties. The phrase wire tapping is due to the device and the method which required to be connected to the wires of the telephone which was to be tapped.

Does Telephone Tapping Need The Authorization Of The Court? The Legal Implications of Telephone Tapping

Of course yes. In all civil societies, telephone tapping requires the authorization from courts concerned. Because it intrudes ones privacy, as such, privacy is a fundamental right in many countries, phone tapping is stringently controlled. Normally phone tapping is allowed when, it is established prima facie that evidence of crime or subversive activity is impossible to collect by another less intrusive method. In the United States it is the United States Foreign Intelligence Surveillance Court that authorizes federal agencies to tap phones.

The Official Tapping Of Telephone Lines and Phone Tap Symptoms

In the US, official phone tapping is an act of lawful interception. Telephone companies are lawfully bound to provide access to law enforcement agencies and police to tap phones under the appropriate law, CALEA. The tapping should not be detectable even with a phone tap detector.

Sometimes, when ‘full scale’ tapping of phones are not required, the detective agencies collect only data about the calling number and the called number including the time and duration of the call with special phone tap equipments such as pen registers and trace devices. This kind of data collection does not have much legal restrictions like that of full scale tapping.

As per Section 18 of the United States Code, pen device is an electronic device used to record “dialing, routing, addressing, or signaling information transmitted by an instrument or facility” but without recording “the communication transmitted by wired or wireless” devices. The same goes for trap and trace devices also, as per USC section 18.
